Many individuals with special needs struggle with the stigma of being perceived as less qualified simply for having a disability. Even if a person does have a physical or mental disability that does not impact their ability to carry out certain duties, they may still be passed over for a job. In these cases, individuals may be the victims of disability discrimination.
Colorado residents may be interested in such a case that recently occurred in another state. Reports stated that a woman had applied for a position as a surgical scrub technician. She was offered the job, but before she could accept the position, she had to pass a medical exam. During the exam, it was revealed that the woman had a minor ankle issue. The ailment would not affect her work in the position, but the company rescinded the offer nonetheless.
As a result of this action, a lawsuit was filed by the Equal Employment Opportunity Commission against the company for discrimination. The suit resulted in the company being ordered to pay $90,000 as well as comply with measures to ensure that such discrimination does not take place again. An external equal employment monitor will help the company comply with the Americans with Disabilities Act.
Though having a disability may make certain aspects of a person’s life more difficult, it does not necessarily mean that he or she is unable to carry out expected duties.
