What Counts As Discrimination Or Harassment?

Under the Civil Rights Act of 1964, an employer with at least 15 employees cannot discriminate against employees or job applicants on the basis of race. This means that an employer cannot hire or fire someone, offer training, provide benefits or offer assignments solely because of a person’s skin color or national origin. Examples of racially motivated discriminatory treatment in the workplace include:

  • Asking job applicants unnecessary or inappropriate questions about race or national origin during the interview process
  • Making derogatory comments about a person’s accent, skin color or national origin
  • Isolating or categorizing employees based on race or physical features, such as skin color
  • Allowing employees to display racially offensive symbols or act inappropriately to employees on the basis of race or national origin
