Many individuals may visit restaurants or other similar establishments and not give much thought to their servers or other workers. It is especially unlikely that the casual customer is concerned with whether the workers are being properly compensated for their work. It was recently reported that a class-action lawsuit was filed in Colorado against popular food chain Chipotle Mexican Grill Inc. According to reports, the claim asserts that workers were underpaid for their services and were not given overtime compensation. As a result of the lawsuit, there has been a call for an investigation into the wage theft allegations.
Reports also state that one significant issue pertaining to pay is that Chipotle workers are automatically clocked out at either midnight or 12:30 a.m., but workers are sometimes required to stay past that time. As a result, workers would not be compensated for those additional hours. It was also reported that workers were required to attend meetings while off the clock.
Filing a wage and hour claim is a serious endeavor, but as this case shows, it may be warranted if workers are not being properly compensated for their services.
